Terms of Service

You must be at least 18 years of age to use this service. By using the API, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

Access to the API requires registration and issuance of an API key. You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or pose a security risk.

You agree not to use the API to:

• Generate content involving minors in any sexual context — this is strictly prohibited and will result in immediate termination and reporting to relevant authorities
• Generate non-consensual intimate imagery (NCII) of real individuals
• Produce content that constitutes harassment, threats, or incitement to violence
• Violate any applicable local, national, or international law or regulation
• Attempt to reverse-engineer, circumvent, or abuse the API infrastructure
• Resell or sublicense API access without prior written consent

Content generation is subject to our Content Policy, which is incorporated into these Terms by reference.

Your content: You retain ownership of any prompts you submit and the outputs generated from them, subject to compliance with these Terms and applicable law.

Our IP: The API, underlying models, infrastructure, and all associated intellectual property remain the exclusive property of the Company. These Terms do not grant you any rights to our trademarks, patents, or proprietary technology.

API usage is billed according to the pricing plan you select. All fees are non-refundable except as required by law or as explicitly stated in your plan. We reserve the right to modify pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of new pricing.

Overdue accounts may be suspended. Disputed charges must be raised within 30 days of the invoice date.

We target 99.9% monthly uptime as stated in our SLA. Scheduled maintenance will be announced in advance. We are not liable for downtime caused by third-party infrastructure failures, force majeure events, or actions outside our reasonable control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the API, your content, or your violation of these Terms.

Either party may terminate the agreement at any time. Upon termination, your API access will be revoked and your data will be deleted per our retention policy. Sections 4, 7, 8, and 9 survive termination.

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law. Nothing in this section limits your statutory consumer rights.

We may update these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the service constitutes acceptance.
